Terms

General Information

All lots are being sold in As-Is, Where-Is condition. We have made every effort to the best of our ability to describe the lots or show condition with pictures. 

 The majority of the pipe was purchased in 2016. Mill Certificates are not available for these tubular products and while we cannot warranty that it meets API specifications, the physical evidence suggests that it does. This evidence includes the API mark on the tubular and the invoices from when the pipe was purchased new describe it as such. This does not apply, however, to any pipe described as “used, reject, limited service or LMS”. We do not offer any warranty or guarantees on the products being sold through the auction website. 

 We offer the ability to inspect the lots prior to the close of the auction, see Inspection Times in the Auction Terms and Conditions.

The seller will not facilitate shipping arrangements. The winning bidder is responsible for arranging the shipping/transportation of all lots won. All shipments must be scheduled for pickup by appointment. There is no charge for loading but due to the volume of this auction, we strongly suggest that call to make your appointment well in advance of the removal deadline. Appointments will be given on a first come first serve basis.

Upon receipt of payment, Men of Steel Auctions will provide, the buyer a Release Number to provide the transportation company picking up the product. The release number will need to be presented to the shipping foreman at the time of load pick up. Loads will not be loaded without being verified by the release number. 


Special Notes

To the Bidder - The lots offered in this auction, unless noted otherwise, are being listed by the truckload. All weights are figured estimates by taking the average length of available product X the weight per foot for each tube. With the average full truckload of pipe being 45,000 pounds we are allowing for a 1-2% variance in the weight, footage or joints shipped. Bidders must take this variance into consideration when bidding on the load. Every effort will be made to ship the stated specifications for the lot.

Types of Payment

All Payments must be received within 4 days of the close of the auction. Auction closes on Dec. 16, 2019, so payments must be made by 3 pm on December 20, 2019. We do not accept partial payments. Invoices must be paid in full. All payments must be in U.S. Funds.

There is a 3% discount on the buyer’s premium only when the invoice is paid in full with Wire Transfer. This discount does not apply to payments made by Credit/Debit Card. All Payments must be made by 3 pm Central Standard Time on December 20, 2019.

Payment Dates

Buyer's Premium Text

A 10% Buyers Premium will be added to the successful bid price on Men Of Steel Auctions and is payable by the Buyer as part of the total purchase price. There is a 3% discount on the Buyers Premium when the purchaser pays the invoice in full via Wire Transfer.

Qualifications for 3% Buyers Premium Discount

Invoice must be paid in full with a Wire Transfer by 3 pm on December 20, 2019, to qualify for a 3% Buyers Premium Discount.

Sales Tax

All sales will be assessed the Kansas State and localities sales tax of 8.5%. Total of Bid and Buyers Premium will be taxed unless you have a Sales Tax Exemption from Kansas. For out of state buyers we need to get a copy of W-9 for the business submitting bids.

Please send the W-9 to info@mosauctions.com to have the sales tax removed from your winning bids at the auction.

Pre-Bidding

You can place bids on an item before the auction starts, starting November 25, 2019, this is especially helpful if you will not be available on the day of the auction.

When an item status shows as “Pre-Bidding” this simply means that bids placed are not displayed on the auction site until the date the auction is scheduled to open.

Although there may actually be pre-bids placed on the item, an item in pre-bidding status will show # of bids placed as 0 and the current bid (required bid) will show as the opening bid.

You may place a pre-bid through the same process as normal bidding. You can monitor & view your bidding activity on items in pre-bid status from your Watch List.

Pre-bidding will begin on November 25, 2019.

When you place a pre-bid if you are notified that your bid is not higher than another user’s pre-bid this means that another bidder(s) has already placed a pre-bid equal to or higher the amount of the pre-bid you are attempting to place. You will need to raise your pre-bid if you want to be in the winning position.

All pre-bids will be tallied and shown when the auction actually begins.


Dynamic Bidding

Posted closing times and displays of Men Of Steel Auctions current time are approximate. Men Of Steel Auctions reserves the right to close early or extend auctions at any time at its discretion. It is strongly recommended that bids be placed early to avoid losing out due to an ill-timed, last minute bid. All times based on Central Standard Time. Dynamic bidding - The dynamic bid on this website is a feature that does NOT allow an item to sell at the end of the auction until there are 10 minutes of bidding inactivity. 

Example:

An item is bid on at 7:50 pm.

An auction is scheduled to close at 8:00 pm. 

When this bid is placed the ending time will automatically extend to 8:10 pm. 

When another bid is placed at 8:01 the auction will extend until 8:20 pm. 

This will give bidder 19 minutes to place another bid. If no bids are placed this auction will conclude at 8:20 pm. 

The key to your dynamic bidding feature is that the auction extends from the preset closing time in 10-minute intervals, NOT 10 minutes from when you placed your bid.

Incremental Bidding

A bid may be placed for any amount equal to or greater than the current required bid amount, which means your bid amount is not required to be an increment of the posted bid increment.

Example:

• Current bid at $10.00 with a bid increment of $5.00.

• The minimum bid required would be $15.00.

• A bid may be placed for any amount equal to or greater than $15.00.

• The bid amount is not required to be in increments of $5.00; therefore a bid could be placed for $17.00 or $76.00 or whatever amount you wish to bid as long as it is equal to or greater than the minimum bid required.

• The winning bid may end up at any amount. It may not be divisible by the stated increment. The winning bid will be the highest.

Refer to the Automatic Bidding section for further explanation of the convenient method of placing an automatic bid.


Automatic Bidding (max bid, auto bid, proxybid)

Automatic Bidding (auto bid) option makes bidding convenient allowing you to enter the maximum bid amount* that you are willing to bid on an item. Based on your Account Preferences for notification, you may be notified whenever your auto bid increases &/or when it is exceeded.

The auction company or other bidders do not have access to see your auto bid amount. You are the only person that can see your auto bid amount (displayed in your Watch List).

Your auto bid will not “jump” to the maximum amount. The auto bid will increment up only with competing bids until either the item completes with you as the high bidder, or until your auto bid has been exceeded by another bid.

If another bidder already has an auto-bid in place when you place your auto-bid, the (2) competing auto bids will continue to increment until either the lower auto bid is maxed out; or if both auto bid amounts are the same the auto-bid that was placed first will become winning position of the bid.

Example #1:

1. The minimum bid is at $10.00 with a $5.00 bid increment.

2. Bidder #1 places an auto bid for $77.00.

3. No other auto bids are in place, therefore Bidder #1 is the high bidder at $10.00.

4. Bidder #2 places an auto bid for $23.00.

5. Bids would compete with each other as follows:

Bidder #1 - $10

Bidder #2 - $15

Bidder #1 - $20

Bidder #2 - $23 (maximum auto bid placed)

Bidder #1 - $25 (high bid position)

The high bid is $25, not $28 because Bidder #2’s auto bid was exceeded at an increment other than $5.

Example #2:

1. The minimum bid is $10.00 with a $5.00 bid increment.

2. Bidder #1 places an auto bid of $77.00.

3. No other auto bids are in place, therefore Bidder #1 is high bidder at $10.00

4. Bidder #2 places an auto bid for $25.00

5. Bids would compete with each other as follows:

Bidder #1 - $10

Bidder #2 - $15

Bidder #1 - $20

Bidder #2 - $25 (maximum auto bid placed)

Bidder #1 - $30 (high bid position)

The high bid is $30 because Bidder #2’s auto bid was exceeded at an increment equal to $5.

Example #3:

1. The minimum bid is $10.00 with a $5.00 bid increment.

2. Bidder #1 places an auto bid of $25.00.

3. No other auto bids are in place, therefore Bidder #1 is high bidder at $10.00

4. Bidder #2 places an auto bid for $25.00 (same amount as Bidder #1 auto bid)

5. Bids would compete with each other as follows:

Bidder #1 - $10

Bidder #2 - $15

Bidder #1 - $20

Bidder #2 - $25

Bidder #1 - $25 (high bid position)

The high bid is $25 with Bidder #1 in high bid position because Bidder #1 placed the $25.00 auto bid before Bidder #2.

Shipping Options / Information

Loadout assistance with a forklift will be available.  We are not charging a load out fee on all lots loaded before Feb. 1st, 2020.


The seller will not facilitate shipping arrangements. The winning bidder is responsible for arranging the shipping/transportation of winning lots. Upon confirmed receipt of payment, meaning completed transaction of payment, the seller will provide to the Buyer a Release Number and location to provide the transportation company, the buyer has chosen to pick up their winning lots. The buyer must call the provided contact number to schedule a pickup appointment, with at least 24 hours notice, prior to the pickup time. The release number will need to be presented at the time of pick up and loads will not be loaded without the release number.

Forklift & Loading Dock

We will have a Forklift and Yard Forman for load out assist.  We will not charge an extra loading fee if picked up before the 1st of February, 2020

Removal Times / Failure to Remove

Normal Week Days Hours 8 am to 5 pm Central Standard. 

Weekend times available by special arrangements only.


A release number will be given to the winning bidder after the payment has been received. That Release Number must be provided by the driver picking up the load to the person in charge at the pick-up address. 24 Hour notice for pick up must be given to guarantee loading time.  

All winning lots must be picked up no later than January 31, 2020. All shipments must be scheduled for pickup by appointment. There is no charge for loading but due to the volume of this auction, we strongly suggest that call to make your appointment well in advance of the removal deadline. Appointments will be given on a first come first serve basis. We will allow for 3 to 5 trucks a day on a first come first serve basis.

At the discretion of MOSAuctions.com, any lots that are paid in full may be held/stored for an additional 10 days for prearranged customer pickup. Bidder explicitly agrees to pay accumulated storage fees which will apply at $500.00 per lot per day for the additional 10 days held by the auction company. Lots will not be held/stored beyond a total of 12 business from January 31, 2020, at which point will be considered abandoned and will be relisted on auction offering for sale to the public.


Refund Policy

All inventory lots of the auction are sold “AS IS, WHERE IS” with all faults. No Refunds, Returns or Exchanges will be issued.  

Storage Fees / Restocking Fees

Liquidated Damages Fee

Bidder Explicitly authorizes the charging of his or her credit card for the liquidated damages fee which are applied when bidder/buyer’s invoice(s) are not paid in full within 4 days of the auction date.

Liquidated damages fee will equal up to 20% of the total purchase price during the auctions or immediately following the auction. Note that the purchase price is the sum of the bid price, buyers premium, buyer’s fee, and sales tax if applicable.

Storage Fees

All winning lots must be picked up no later than January 31, 2020. The pickup must be scheduled with at least a 24 hour lead time. We will allow for 3 to 5 trucks a day on a first come first serve basis.

At the discretion of MOSAuctions.com, any lots that are paid in full may be held/stored for an additional 10 days for prearranged customer pickup. Bidder explicitly agrees to pay accumulated storage fees which will apply at $500.00 per lot per day for the additional 10 days held by the auction company. Lots will not be held/stored beyond a total of 12 business from January 31, 2020, at which point will be considered abandoned and will be relisted on auction offering for sale to the public.
